The Tesla Autopilot recall shows that our regulatory language and frameworks are outdated. The word “recall” evokes the image of 2 million cars being brought back to dealerships, when this is a pretty simple OTA software update. The corollary here would be Apple shipping a security update to all phones and people reporting it as a “recall”. NHTSA is going to have to change its language to adapt to the future that is already here to help consumers understand when a vehicle issue requires dealer intervention vs. a software update.
