कर्नाटक हाई कोर्ट ने पतियों के लिए एक महत्वपूर्ण फैसला देते हुए कहा कि यदि पत्नी को पहले से ही धारा 125 CrPC के तहत maintenance मिल रहा है, तो उसी अवधि के लिए Hindu Marriage Act की धारा 24 और DV Act के तहत समानांतर maintenance नहीं दिया जा सकता।

कोर्ट ने कहा कि एक ही उद्देश्य के लिए अलग-अलग कानूनों के तहत बार-बार maintenance देना “duplication of relief” माना जाएगा। हालांकि litigation expenses अलग विषय हो सकता है।
यह फैसला उन मामलों में महत्वपूर्ण माना जा रहा है जहाँ पति पर अलग-अलग कोर्टों में multiple maintenance cases डालकर आर्थिक दबाव बनाया जाता है।
