Yo no he mentido en mi publicación: me he limitado a afirmar que el Juzgado de Instrucción, en su auto de septiembre de 2023, declaró que no estábamos ante un delito de corrupción deportiva y encuadró los hechos exclusivamente como un posible delito de cohecho. Esa afirmación es rigurosamente cierta y se ajusta milimétricamente al contenido de dicho auto. Otra cuestión, completamente distinta, es lo que la Sección 21.ª de la Audiencia Provincial de Barcelona resolvió meses después, al revocar en mayo de 2024 aquella decisión del instructor. Esa resolución posterior no convierte en falsa ni en engañosa mi referencia al criterio inicial del juez, porque yo estoy describiendo lo que el juez dijo entonces, no lo que la Audiencia ha declarado después. Por tanto, el planteamiento erróneo no es el mío, sino el suyo: usted mezcla un auto intermedio de instrucción con la situación procesal actualmente firme para intentar desacreditar unas palabras que, en su contexto temporal, son exactas. Y o describo con precisión el contenido del auto de 2023; es usted quien está tratando de confundir a los demás sobre lo que realmente dicen mis palabras.
