Traffic stop turns into a call to ICE as a van load of illegals discovered with one that was a prior deportation that snuck back in.
We are in Rochester, New York, where a targeted operation to apprehend a previously deported felon is underway.
โThe entire operation stemmed from a federal surveillance detail on Orange Street in Rochester. HSI agents were actively tracking 25-year-old Wilson Oswaldo Galvan-Lopez, a citizen of Guatemala.
โGalvan-Lopez was not just an illegal immigrant, he was a federal immigration fugitive. He had previously been apprehended by U.S. Border Patrol in Arizona and was formally deported back to Guatemala in May 2023. Sometime after his removal, he snuck back across the border, triggering a federal felony violation under 8 U.S. Code ยง 1326 for Illegal Reentry.
โFederal agents intercepted Galvan-Lopez on Whitney Street while he was riding in a red van utilized for local roofing work. He wasn't alone; his father, Luis Galvan-Lopez, and his brother, Willie Galvan-Lopez (neither of whom held U.S. citizenship), were also inside.
โWhen agents and local backup ordered the driver out, a tense standoff ensued:
โA woman outside the van became visibly distraught, screaming at officers and attempting to block the driver's side door.
โWhen she aggressively approached the line, an officer issued a sharp warning: "Do not touch my officers!" When she protested that she was a woman, the officer firmly responded, "I don't care, I just did [protect them]."
โAs the occupants continued to ignore commands to exit, an officer deployed a window punch tool, shattering the glass. Officers bypassed the barricaded door, pulled the driver from the vehicle, and placed him in handcuffs.
โThe woman continued to interfere, demanding the vehicle keys and stepping into the active scene. Officers warned her she would face charges for OGA (Obstructing Governmental Administration) if she didn't step back.
โWhile the arrest was executed successfully, it ignited a massive political and legal battle in New York. Ten Rochester Police Department (RPD) officers had responded to the scene to assist the federal agents with the extraction and crowd control.
โBecause Rochester identifies as a "sanctuary city," Mayor Malik Evans and Police Chief David Smith publicly questioned whether their own local officers violated city policy by assisting with an immigration enforcement action. This public pushback triggered a severe counter-reaction, leading to a subsequent federal administration lawsuit against the city over its sanctuary policies. RPD officers on the scene maintained they were strictly there to maintain public safety and assist with a "government thing" that they did not initiate.
โFollowing the arrest, the occupants were separated:
โWilson Oswaldo Galvan-Lopez stood before U.S. District Judge Meredith A. Vacca, utilizing an interpreter to enter a guilty plea to the federal felony of Illegal Reentry. He was sentenced to time served, given a one-year supervised release, and immediately transferred back to ICE custody for formal deportation.
โThe Family: His father and brother were transported to an immigration detention facility in Batavia, New York, before being moved to a detention facility in New Mexico to await the evaluation of their immigration status.
