You will agree that a convict has the legal right to appeal the decision(s) he or she is aggrieved with.
That's what the appellant did in this matter.
Also, he was convicted and sentenced to death. At that point, he had nothing to lose but something to gain if his appeal had succeeded.
He practically tried his luck.

Why should he even be appealing for such a grievous crime in the first place. Testing the sanctity of the Law?
