Former prisoners now risk re-imprisonment over fines linked to cases covered by the pardon. Although #Bahrain said the pardon included cancelling such fines, they are now being demanded again under threat of jail.

@ADHRB urges Bahrain to halt all actions related to cases covered by the royal pardon, cancel prison orders based on these fines, release anyone detained on this basis, and uphold legal certainty by preventing double punishment for the same acts.

تدين @ADHRB ملاحقة #البحرين للسجناء السياسيين المفرج عنهم ضمن العفو الملكي عام 2024، عبر مطالبتهم بدفع غرامات مالية أو العودة للسجن. تمثل هذه الإجراءات تراجعًا خطيرًا عن الوعود الرسمية، وتقوض الثقة بمفاعيل العفو وإجراءات العدالة الانتقالية، وتضع الأسر أمام تهديدات مالية وقانونية.

يواجه المفرج عنهم خطر العودة إلى السجن بسبب غرامات مرتبطة بقضايا شملها العفو. ورغم تأكيد #البحرين سابقًا أن العفو يشمل إسقاط الغرامات، تُعاد المطالبة بها اليوم تحت طائلة السجن، في إجراء يتعارض مع الأثر القانوني للعفو ويقوض اليقين القانوني والعدالة الانتقالية.

تدعو @ADHRB البحرين لوقف إجراءات الملاحقة المرتبطة بالقضايا المشمولة بالعفو الملكي، وإلغاء أوامر السجن بسبب الغرامات، والإفراج الفوري عن أي شخص أُعيد توقيفه على هذا الأساس. كما تطالب بتوضيح قانوني يضمن احترام مبدأ اليقين القانوني وعدم معاقبة الأفراد مرتين على الوقائع ذاتها.
