I had a chance to watch what happened last night and gather all the facts regarding the arrest of Alex Zabel Jr. (Criminal Network).
Nancy Guthrie's neighborhood has a HOA.
🔹HOAs treat common areas, streets, sidewalks, and amenities as private property.
If an authorized person tells you to vacate and you refuse or return, it can be criminal trespass in most states.
Police can arrest you on the spot.
Nuisance / Disorderly Conduct:
Live streaming that
🔹blocks roads
OR
🔹creates noise
OR
🔹attracts crowds
OR
🔹becomes a repeated disturbance
can lead to citations or arrest, especially after complaints and warnings.
Filming Rights:
🔹First Amendment protections are strong in truly public spaces but weaken or even disappear on HOA controlled property or after a lawful order to leave.
Filming while trespassing is not protected speech.
🔹Bottom line:
Leave when asked.
Compliance avoids most issues.
Refusing or returning increases arrest risk.
I don't feel sorry for him.
He was warned and arrested once already for this crap.
He acknowledged that he was asked to vacate but still came back because "my rights".
Dude, Being on HOA property already limits your rights and those rights definitely end when you disturb the entire neighborhood.
