Doré is meant to be "robust" and to ensure that a decision "gives effect, as fully as possible, to the Charter protections at stake". But it also requires deference to the decision-maker, and does not require that they "choose the option that limits the Charter protection least".

As administrative schemes go, professional regulation is unusual. Most members of our governing bodies are not appointed by the government, but elected by those who are subject to regulation. There are pros and cons to this approach, but it's the one we've got in Ontario.

It's a privilege to elect those who regulate us, but also a kind of responsibility. In the case of lawyers and paralegals, the benchers we elect govern the affairs of the Law Society, which has various public duties, including the duty to protect the public interest.
