So happy that my latest article, coauthored with @jananiu, is forthcoming in the @HarvardCRCL Law Review! Using qualitative data and the 5th Amendment's Takings Clause, we argue that harsh treatment of the incarcerated may violate the constitutional rights of free people.
The failure of the state to provide basic necessities to incarcerated populations imposes genuine coercion on private citizens to provide those necessities at personal expense. We analyze this dynamic as a taking. Draft here: shorturl.at/95RGk. Comments welcome!
Grateful to have had the chance to present recommendations on human rights and racial justice with @AlexSinha at the White House and deliver a memo to @neeratanden & the Domestic Policy Council.
Excited to share my latest article, Policing's Free-Speech Problem, forthcoming in the @UtahLawReview. I argue that significant, typical elements of modern policing amount to egregiously unconstitutional viewpoint discrimination. Comments welcome: rb.gy/8y6106!
Stalkers are not uncommon in the academic world unfortunately.
I gave this interview a year ago and now it is out in @verge. As some of you know, Sara Hunter has been harassing me for years. This is a story about racism and police inaction. (1/8) theverge.com/c/features/2390…
For the last four years, my family and I have been stalked by a self-described racist who hates Asians. I've never even met her, but she wants us dead. Authorities have been mostly indifferent. I talked about it publicly for the first time with @verge: bit.ly/3MhqICi 1/
This case highlights serious risks for marginalized faculty. I've never taught Sara, but this started when she targeted one of her own profs four years ago, a woman of color. Today she has several main targets, all professors and mostly POC, like my friend @Catherineoscopy. 10/
There have got to be more institutional resources for faculty facing down animus. Having to do it alone is scary and isolating, and it only compounds the distinctive taxes already paid by vulnerable faculty simply for being who we are. 11/11
Love this thread! The Biden administration has made many statements about promoting racial justice, but it has neglected some of its most powerful tools. Human rights law is at the very top of that list.
A year ago, the UN CERD Committee slammed the US for its human rights record on eliminating racial discrimination. Indeed, data suggest that in some areas, outcomes impacted by discrimination have gotten worse since the US ratified the treaty. ohchr.org/en/documents/concl…
