While prosecutors, who should know the law, and others who attended the private meeting with the DA where no other members of the potential jury pool were invited, the focus on the body cam footage seems to dominate the discussion. The truth is It does not boil down to just that footage in use of force cases. I renew my call for people to read my OP-ED explaining how it works in a way that the Supreme Court dictates and how it protects the constitutional rights of Officer O'Malley...something never even mentioned by the DA publicly or likely in the DA's private meetings with people who could be called as jurors. commonwealthbeacon.org/opini…

This almost certainly violates Massachusetts' (and almost every state's) Rule 3.8 prohibition against prosecutors making unnecessary extrajudicial statements which likely will prejudice a defendant in an open case. Making such statements in a "closed, invite only setting" is even worse because there may be no record of what was said to whom and for what purpose. Was this more of a political gathering for an incumbent to use O'Malley's scalp as a campaign tactic to certain segments of the Suffolk electorate?

For the record, we are well aware of the “invitation-only” community event this afternoon hosted by Suffolk County District Attorney Kevin Hayden (@SCDAONews) about the #NickOMalley case. We highly suggest that his office review and study Rule of Professional Conduct 3.8(f)(1) before attempting to proactively poison the jury pool against a police officer who was doing his job by protecting his partner and the public. We expect to have more to say in the upcoming weeks and months. Suffice it to say, prosecutorial misconduct will not be tolerated. #FreeOMalley

It's easy for the DA to stand safely on a sidewalk and announce that in hindsight the officer was NOT reasonable when he used force. Like the justices said, these are "rapidly-evolving circumstances." The public, like you, gets it.
