My opinion - Sorsby isn't worth it. TTU can't afford to alienate the entire Big 12. And its a mistake for them to do so.

As for a legal challenge... TTU signed the by-laws... Note that Oklahoma/Boren pushed for a legal setup designed to prevent Texas leverage from dominating the league. The Big 12 is a Delaware corporation headquartered in Irving, Texas, and that corporate powers are subject to the Delaware General Corporation Law.

The Big 12 could respond that its internal governance is controlled by Delaware corporate law, but absent a clear forum-selection clause in the public bylaws, I would not assume the Big 12 can simply force the matter out of Texas.

My take is this... The Big 12 could easily adopt a rule that allow them to punish TTU severely. They have the votes.

The Big 12 rules start from a broad compliance premise. Big 12 members must comply with NCAA rules and Conference rules, accept primary responsibility for rules administration, investigate known or alleged violations, and take prompt corrective action where violations occur.

It then says results achieved by the ineligible athlete or institution may be vacated, awards/trophies may be returned, and additional penalties may be assessed. That is the Big 12’s best textual vehicle. If the Conference believes Sorsby remains “ineligible” despite the temporary injunction, it could try to say Texas Tech’s participation with Sorsby triggers Rule 7.4.

I do not find that Big 12 by-laws support forfeiture. For eligibility violations, the term used is vacatur, return of awards, and “additional penalties,” not “forfeit.” That difference matters. A “forfeit” changes the win/loss result in a standings sense. “Vacated” results can erase or nullify accomplishments without necessarily awarding wins to opponents.

Big 12 is seriously considering declaring TTU conf games were Sorsby participates as forfeits. Sorsby can be on the roster. He just can't play. Conf assumes a TTU lawsuit. Big 12 likely to be the first to file to control venue.
