ALT Our recommendations are aimed at supporting testamentary freedom, protecting testators, and increasing clarity and certainty in the law. The final report is accompanied by a draft Bill for a modern Wills Act, to replace the Wills Act 1837.

ALT Recommendations include…Enabling electronic wills. Abolishing the law that revokes a person's will when they marry or enter a civil partnership. Making it easier for a person's wishes to be given effect . Reducing the minimum age at which a person can make a will from 18 to 16. Clarifying the requirement for mental capacity, Increasing protection to those coerced into making a will.

Another decision on the interplay between s2 LP(MP)A and proprietary estoppel handed down today in which I acted for the Claimant. HHJ Mithani decided that s2 did not prevent him from ordering specific performance of an oral contract for the sale of land.

In addition, the Court found that where the parties had not agreed all of the terms of the purchase but had agreed essential terms, terms would be implied where required pursuant to “open contract” principles.
