Something everyone should think about, but that is rarely discussed: When a school fails to provide services to a student, there is often little meaningful recourse for parents. Yes, parents can file complaints and report violations, but real systemic change rarely happens through a local complaint process. Even state complaints do not necessarily force a district to make substantial changes. In many cases, meaningful accountability only comes through an OCR complaint or due process. While some states allow non-attorney advocates to participate in due process hearings, very few advocates actually do because of the complex legal standards and procedures involved. OCR complaints typically require attorney involvement, are expensive, and often take years rather than months to resolve. Like any legal matter, parents can represent themselves. However, the school district will almost always have legal counsel, funded by taxpayer dollars, while parents are left paying out of pocket to fight for services their child was already legally entitled to receive.
