What makes a law fair? To answer, perhaps you could consult the 2.25 meter tall Code of Hammurabi, an ancient legal text still revered to this day. ⬇️
The Code of Hammurabi is around 4,130 lines long, with a prologue that occupies 300 lines and an epilogue that occupies 500. Between the prologue and epilogue is the center of the text, a list of “laws.”
Many of the laws in the Code of Hammurabi are based on the legal concept of “lex talionis,” or “an eye for an eye,” a system of equal retribution for offenses. Though it is called a code, modern scholars debate whether it was truly a record of rules that were enforced or more of an essay about the principles Hammurabi believed should guide the law.
The prologue establishes Hammurabi's royal authority, claiming he was appointed by the gods “to prevent the strong from oppressing the weak.” It also lists his achievements and virtues. The epilogue contains a 281-line series of curses against anyone who would deface the Code of Hammurabi.
The first copy of the text, rediscovered in 1901, can now be found on the ground floor of the Louvre Museum, in Paris, France.
