This is even worse! Some harms are not justifiable. That doesn't mean irreparable. The APA's denial of availability of money damages is not an automatic grant of irreparable harm. If that's the case, many courts have erred badly for decades. Really just sloppy analysis.

Does federal law require post-2020 woke ideology at national parks? Yes, per Judge Kelley (Biden D. Mass). She orders it *illegal* for National Parks not to share exhibits with her preferred views on the climate, sexuality, and race. I'm skeptical!

A woman works at the American Association for State and Local History. Her income depends on installing woke park exhibits. Stopping that will hurt her income. This seems more like a grant issue that should be in the Court of Federal Claims (maybe!) than in this suit!

I really don't get the irreparable harm analysis. This isn't a constitutional claim. There's no 1A "any deprivation is irreparable" issue. Can't the harm be later repaired, if needed, by replacing the signs? Seems super reperable! I agree that aesthetic harm is hard to quantify

I 100% agree with Trent. Something weird is going on with the courts. Why are they *mandating* user multifactor authentication? Why are they mandating changing every six months? People will start using passwords like idiots use on their luggage!
Stop the PACER password madness. First MFA then this, which means everyone will write down PWs, making them less safe. No basis to believe PACER was compromised from filer side. Next: passwords must be 255 characters, changed every 24 hrs, accessible only from a SCIF.

To me, this seems like a big problem. There is a high profile dispute over immigration law. The federal circuit court takes a case, issues a quick opinion, and resolves it. Then, the district judges shift to give the same relief under a different line of argument? I'm skeptical!

Some of the continuing results of the order are a bit wild. The Chief Judge will babysit, checking in with the clerks every three months for two years, to ensure that the Judge is not creating the same culture of fear. I guess that's nice!
