وفاقی آئینی عدالت کا کروڑوں پرائیویٹ ملازمین کے حق میں بہترین فیصلہ پرائیویٹ ملازمین 15 سال سے کم ملازمت پر بھی اپنے اداروں میں پنشن کے حقدار👇 👇👇 محمد رفیق نے 14 سال 9 ماہ، دو مختلف فیکٹریوں میں بطور ورکر کام کیا۔ 2018ء میں 60 سال ریٹائرمنٹ کی عمر کو پہنچنے پر رفیق نے EOBI میں پنشن کیلئے درخواست دی۔ تاہم درخواست یہ کہہ کر مسترد کر دی گئی کہ EOBI قانون کے مطابق انشورڈ ملازمت (یعنی وہ مدت میں جس میں ہر ماہ تنخواہ سے EOBI کی کٹوتی ہوتی رہی ہو) کم از کم 15 سال ہونی چاہیے، جبکہ تمہارے تین ماہ کم ہیں۔ رفیق نے EOBI کیخلاف لاہور ہائیکورٹ سے رجوع کیا۔ رفیق کے علاوہ چار اور ورکرز یعقوب، شہباز، عمران اور رشید بھی تھے، جنکی انشورڈ ملازمت کی مدت ساڑھے 14 سال سے زائد مگر 15 سال سے کم تھی۔ ان سب کو بھی EOBI نے اسی وجہ سے پنشن دینے سے انکار کیا، یہ بھی لاہور ہائیکورٹ پہنچے۔ ہائیکورٹ میں ملازمین نے موقف اختیار کیا کہ EOBI قانون کے شیڈول میں واضح لکھا ہے کہ 6 مہینے یا اس سے زیادہ کی ملازمت کو ایک پورا سال شمار کیا جائے گا۔ ہم سب 14 سال 6 ماہ سے زیادہ کام کر چکے ہیں، یوں ہمارے بھی 15 سال بن جاتے ہیں۔ ہمیں پنشن دی جائے۔ ای او بی آئی نے موقف اپنایا کہ دفعہ 22 کے مطابق 15 سال لازمی ہیں۔ شیڈول صرف پنشن کی رقم نکالنے میں حساب کتاب کیلئے ہے، اہلیت طے کرنے کیلئے نہیں۔ ساڑھے 14 سال کو 15 سال نہیں بنایا جا سکتا۔ ہمارا سرکلر نمبر 1/2022 بھی یہی کہتا ہے۔ لاہور ہائیکورٹ نے اگست 2024ء اور مارچ 2025ء کو ملازمین کے حق میں فیصلے دیے اور قرار دیا کہ EOBI ایک فلاحی ادارہ ہے، اس لیے قانون کی تشریح ملازمین کے فائدے کے لیے ہونی چاہیے۔ عدالت نے ادارے کو حکم دیا کہ ان سب کو ماہانہ پنشن ادا کی جائے۔ ہائیکورٹ کے ان پانچوں فیصلوں کیخلاف EOBI نے سپریم کورٹ میں اپیل دائر کر دیں۔ جو بعد ازاں آئینی معاملہ ہونے کی بناء پر وفاقی آئینی عدالت کے تین رکنی بنچ نے سنیں۔ جہاں فریقین نے اپنا موقف دہرایا اور دسمبر 2025ء میں جسٹس حسن اظہر رضوی نے فیصلہ تحریر کیا۔ عدالت نے کہا کہ EOBI قانون کا مقصد بزرگ ملازمین کو بڑھاپے میں محتاجی سے بچانا ہے۔ اسے محض ریاضی کے فارمولوں سے نہیں بلکہ انسانی ہمدردی اور انصاف کے اصولوں پر دیکھنا چاہیے۔ اگر کوئی مزدور ساڑھے 14 سال سے زیادہ کام کر چکا ہو تو صرف 6 مہینے یا اس سے کم کی کمی کی وجہ سے پنشن روکنا، ناانصافی ہوگی۔ شیڈول میں لکھا ہے کہ 6 مہینے یا زیادہ کی ملازمت، ایک سال کے برابر ہے۔ یہ صرف پنشن کی رقم نکالنے کا فارمولا نہیں، بلکہ پنشن کی اہلیت طے کرنے کا طریقہ بھی ہے۔ دفعہ 22 کے ساتھ جب شیڈول ملا کر پڑھیں تو سب کے 15 سال پورے ہو جاتے ہیں۔ "راؤنڈنگ آف" کے اس اصول کو سپریم کورٹ پہلے بھی کئی فیصلوں میں تسلیم کر چکی ہے۔ 2022 والا سرکلر قانون سے متصادم ہے۔ مزدوروں کو پہلے سے حق مل چکا تھا، اسے کسی نوٹیفکیشن یا سرکلر کے ذریعےختم نہیں کیا جا سکتا۔ تمام ملازمین ماہانہ پنشن کے حقدار ہیں۔ وفاقی آئینی عدالت نے EOBI کی تمام اپیل خارج کر دیں۔ ۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔۔ نوٹ:- ای او بی آئی ایک سرکاری فلاحی ادارہ ہے جس کا مقصد پرائیویٹ اداروں میں کام کرنے والے ملازمین کو ان کی ریٹائرمنٹ کے بعد ماہانہ پنشن اور مالی تحفظ فراہم کرنا ہے۔ اس فیصلے کو تمام فیکٹریوں اور کمپنیوں میں کام کرنے والے ملازمین کو لازمی پڑھنا چاہیے۔ #Law #Pakistan #FCC #Pension #Insurance #Labour #Rights #JusticeHassanAzharRizvi #EOBI
