North Dakota’s licensing law leads to absurd results:
👉 A retired chemistry professor with a Ph.D. and decades of teaching experience is barred from teaching high school chemistry.
👉 A celebrated novelist, with books lining library shelves, is barred from teaching middle school English.
👉 A Pulitzer winner cannot teach journalism.
👉 A working engineer retired from Silicon Valley cannot teach computer science.
In North Dakota, none of them are qualified—because none of them hold the state’s #license.

North Dakota is 1 of only 2 states that require every private school teacher (no matter their education, expertise, or experience) to first obtain a state teaching license.
Worse, the state then picks and chooses which courses a licensed teacher is allowed to teach.

Today IJ and Capstone Classical Academy filed a federal lawsuit challenging the North Dakota law that makes it nearly impossible for private schools to hire the qualified teachers they want.

.@IJ has cert. petitions pending in both Carlos’s and Amy’s cases. They call out the circuit splits over how the Takings Clause applies to destructive SWAT raids.
Pena v. LA and Hadley v. South Bend will be considered on the Supreme Court’s long conference this fall.

It’s also what happened to Carlos Pena & Amy Hadley.
A SWAT team destroyed Pena’s business after a suspect locked himself inside. Police wrecked Hadley’s home after a botched investigation led them there.
Neither committed a crime. The government gave them both nothing. /8

This City Banned Single-Family Homes—But Not Nightclubs
Art Yatsko spent years planning to build a home for his retirement in Florida. He bought a lot, paid the taxes, saved his money, and designed his dream house.
Then the city told him it was illegal to build a single-family house in a neighborhood made up entirely of single-family houses.
The city *will* allow him to build a nightclub or a shooting range—but not the home he's been planning for decades.
That's irrational.
Now Art and IJ are challenging it in court.

“I understand that the police had to get this guy off the streets but the fact that the city refused to pay for the damage was not fair,” says Vicki Baker. “I hope this sends a message to all cities in Texas that innocent people should not be forced to pay when this sort of thing happens.”

Laura's garden is safe!
After the Institute for Justice stepped in, the village of Millstadt, Illinois has agreed not to pursue enforcement action against resident and botanist Laura Schaefer over her garden. 🌱
After 5 years of transforming a vacant lot into a flourishing garden of native plants, flowers, and vegetables, Laura was shocked when the village hit her with a citation for ‘high grass and weeds.’
She was given 7 days to rip out her garden before the village sent employees to destroy the garden—at Laura's expense.
But after IJ informed village officials that the Illinois Garden Act protects residents' right to grow food at home, the village confirmed it would take no further action against Laura or her garden.
