Sounds like the DA is trying to make extra things stick as an example.
The new charges - felony 2nd-degree assault and misdemeanor 3rd-degree assault - were added even though police officers on the scene decided "there was no probable cause for assault charges given conflicting statements and lack of specific evidence."
Cooper's girlfriend stated in her affadavit that Cooper "grabbed her neck with one hand and lifted her off her feet" for "approximately one minute." The girlfriend also stated Cooper "proceeded to pick her up and throw her back on the floor approximately three times."
The officer observed a small mark on the girlfriend's neck and scratches on the girlfriend's arms and hand, but wrote in her affadavit the girlfriend's "markings and scratches did not appear consistent" with the girlfriend's claims.
