🚨 Tax Policy Alert: Texas Data Centers If you have not yet seen it, Governor Abbott issued a directive this week to the PUC and ERCOT that could have significant implications for data center development in Texas. Among the items included is a pledge to work with the Legislature to repeal sales tax exemptions and other incentives for data centers. While much of the attention will focus on grid reliability and infrastructure costs, the potential impact on future investment decisions and economic development will be worth watching closely. As policymakers evaluate potential changes, it will be important to consider both the costs and the benefits that large-scale capital investment brings to Texas, including jobs, economic activity, and state and local tax revenues. Last week will forever be one of the most memorable weeks of my life. First, @jdecuir_23 & @CurDogBaseball celebrated as 3-peat state champs in one of the wildest high school baseball games (15 innings) you could ever witness. In the same week, I also received “the call” from both @CHSBRAthletics @HUBisonSports that I was being inducted into their HOF for my contributions to @chsbr_soccer @HUBISONFOOTBALL. I am extremely honored, grateful and humbled by it all.

How do companies actually get approved for the Texas Enterprise Zone Program? Many assume it’s just an application process. In reality, it’s a competitive, scored evaluation, and how a project is structured can materially impact approval. Enterprise Zone designations in Texas are awarded through quarterly rounds based on three key factors: • Distress of the project area (demographics, unemployment, poverty levels) • Local incentives and government support • Capital investment, job creation, and wage levels That means two similar projects can have very different outcomes depending on how the application is built and supported. Quick property tax insight: The recent surge in WTI oil prices doesn’t automatically translate into higher mineral property tax valuations in Texas. Under Texas Tax Code §23.175, the oil and gas prices used in appraisal models are statutorily determined, so current market spikes would not directly drive property tax values higher. That said, mineral valuations are still an opinion of market value as of January 1, and other non-pricing factors within the discounted cash flow model, including production forecasts, lease operating expenses, discount rates, and economic life, can still significantly influence the final valuation. Worth keeping an eye on as we move through the middle of appraisal season.
