Our jury system is fundamentally broken, and it’s a simple math problem of culture.
The concept of a 12-person jury traces back to the 1200s—Magna Carta era England. Back then, it worked because of one massive variable: a unified culture. Jurors shared the exact same religion, the same jobs, the same worldviews, and the same way of life. They didn’t have to debate how to see the world; they just had to decide if someone broke the rules of that shared world.
Fast forward to America in 2026.
We have completely abandoned a unifying culture, yet we are still using an 800-year-old operating system. When you pull 12 people into a modern courtroom, you aren't just looking at the facts of a case anymore. You are forcing a collision of radically different education levels, political tribalism, racial dynamics, and foreign-born vs. native-born experiences.
Before a modern jury can even look at the law, they have to wade through a minefield of conflicting cultural biases.
An institution built for absolute homogeneity cannot survive absolute polarization. The American jury system is failing because a "jury of your peers" doesn't mean anything when we no longer share a common reality.
