Serving as Lead Counsel, Labaton Keller Sucharow secured a $210 million settlement to resolve a securities fraud class action against The Estée Lauder Companies Inc. and certain executives. The suit arises from claims that Estée Lauder, the global leader in luxury cosmetics and skincare, misled investors by touting strong revenue growth while concealing the company’s heavy reliance on grey-market sales channels like “daigou,” a practice where resellers purchase luxury goods at reduced, duty-free prices and resell them to end-consumers below retail price. After a regulatory crackdown on resellers, Estée Lauder’s sales took a significant hit and inventories piled up, forcing the company into steep discounts that crushed their revenues and profit margins. The Firm overcame several hurdles in the prosecution of this matter, notably overcoming Defendants’ motion to dismiss in March 2026.  Pending final court approval, the $210 settlement is one of the largest securities recoveries of the year. labaton.com/news-insights/la…

As Generative AI (GenAI) becomes increasingly integrated into document collection and courts have yet to weigh in on its use, Partner Michael H. Rogers and Associates Stephen C. Boscolo and Grace Harmon advocate for the application of existing validation and transparency requirements governing Technology Assisted Review (TAR) in their article “TAR and Feather Them: How Principles of TAR Can Influence Use of GenAI” published by @NYLawJournal. To help ensure that GenAI tools capture a critical mass of responsive and relevant documents, the authors identify two key TAR guardrails that should be applied to GenAI review: results validation, which requires disclosure of metrics demonstrating that TAR successfully collected a critical mass of responsive and relevant documents, and seed set transparency, which requires disclosure regarding how a TAR model was trained.
