When the only option to decline is "don't use our service" and/or "delete everything you've uploaded before AI even existed", then there's no consent and it shouldn't be legal. Especially when thousands of artists who uploaded have died before AI existed.

The issue is never stating the use of AI even if it’s just for placeholder assets
Otherwise, just looks like you’re trying to slip it in unnoticed and get away with it. Even if that wasn’t your intention, you’re still unintentionally normalizing practices that hurts the medium
