🔴 𝐒𝐨𝐦𝐚𝐥𝐢𝐥𝐚𝐧𝐝’𝐬 𝐒𝐨𝐯𝐞𝐫𝐞𝐢𝐠𝐧𝐭𝐲 𝐈𝐬 𝐍𝐨𝐭 𝐚 𝐃𝐞𝐛𝐚𝐭𝐞 Under 𝗔𝗿𝘁𝗶𝗰𝗹𝗲 𝟭𝟬𝟮 of the United Nations Charter, 𝒆𝒗𝒆𝒓𝒚 𝒍𝒆𝒈𝒂𝒍𝒍𝒚 𝒃𝒊𝒏𝒅𝒊𝒏𝒈 𝒕𝒓𝒆𝒂𝒕𝒚 𝒃𝒆𝒕𝒘𝒆𝒆𝒏 𝒔𝒕𝒂𝒕𝒆𝒔 𝒎𝒖𝒔𝒕 𝒃𝒆 𝒓𝒆𝒈𝒊𝒔𝒕𝒆𝒓𝒆𝒅 𝒘𝒊𝒕𝒉 𝒕𝒉𝒆 𝑼𝑵 𝑺𝒆𝒄𝒓𝒆𝒕𝒂𝒓𝒊𝒂𝒕 𝒕𝒐 𝒃𝒆 𝒊𝒏𝒗𝒐𝒌𝒆𝒅 𝒃𝒆𝒇𝒐𝒓𝒆 𝒂𝒏𝒚 𝑼𝑵 𝒐𝒓𝒈𝒂𝒏. What is written, registered, and archived is what exists in law. What is not, does not. In June 1960, the 𝗨𝗻𝗶𝘁𝗲𝗱 𝗞𝗶𝗻𝗴𝗱𝗼𝗺 𝗼𝗳 𝗚𝗿𝗲𝗮𝘁 𝗕𝗿𝗶𝘁𝗮𝗶𝗻 𝗮𝗻𝗱 𝗡𝗼𝗿𝘁𝗵𝗲𝗿𝗻 𝗜𝗿𝗲𝗹𝗮𝗻𝗱 signed a legally binding independence agreement with the 𝗚𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁 𝗼𝗳 𝗦𝗼𝗺𝗮𝗹𝗶𝗹𝗮𝗻𝗱. That agreement entered into force, was recognized internationally, and was registered with the United Nations Secretariat. Somaliland existed legally, politically, and sovereignly. By contrast, there is no UN-registered treaty of union between Somaliland and Somalia that satisfies 𝗔𝗿𝘁𝗶𝗰𝗹𝗲 𝟭𝟬𝟮. The so-called “Act of Union” was never jointly ratified, never lawfully harmonized, and never registered with the United Nations. Under international law, an unregistered treaty cannot be invoked, meaning the claimed union had no legal standing. Somalia’s existence as a unified state rests on a political narrative, not a lawful foundation. A state cannot lawfully absorb another sovereign state without a valid, registered international agreement. That never happened. Therefore, there was no legitimate United Somali Republic, only the unlawful administrative occupation of a sovereign state. From 1960 onward, the only legally valid state in the territory was Somaliland. Today, the international community continues to reward illegality while ignoring its own charter. The United Nations cannot selectively apply international law. If treaties define statehood, then Somaliland’s sovereignty is not a request; it is a documented fact.
