Although these laws have become more restrictive, many states still lack elements that are expected to increase the likelihood that relinquishment will occur (e.g., limiting court discretion, specifying time limits, requiring proof of transfer).
Provisions that outline clear requirements for judges, prohibited possessors, and law enforcement may help to ensure that firearms are relinquished after a possession disqualification.

We recorded key elements of relinquishment laws for DVPOs and convictions on a state-year basis (see Appendix for chronological changes in each state).
We also highlight recent gaps in relinquishment policies as of January 2023 (Tables 1 and 2).
States have increasingly addressed this issue by enacting laws that direct or allow judges to order a prohibited possessor to relinquish their firearms.
Federal law prohibits firearm possession by respondents to qualifying DVPOs and those convicted of felonies and DV misdemeanors.
It does not provide a formal mechanism to enforce these prohibitions, which may contribute to illegal firearm possession.
