The asylum ban, an administrative rule that went into effect in May, creates a presumption that migrants who arrive at the U.S.-Mexico border are ineligible for asylum unless they sought and were denied asylum in a country they traveled through to reach the U.S. The ban has limited exceptions for emergencies and for migrants who have an appointment with immigration officials from the CBP One app, which is inaccessible to many migrants. The ban forces asylum seeker to wait in dangerous conditions to enter the U.S. or be sent away without the ability to apply for asylum.

On Tuesday, U.S. Judge Jon Tigar ruled that the ban is illegal. Judge Tigar reaffirmed U.S. law that states that irregularly entering the U.S. is not a valid reason for a person to be denied asylum. Congress intended for asylum to be a lifeline for people with no other safe options. The restrictions harm asylum seekers who cannot use other pathways and for whom a third country is not a safe option.
ALT What Comes Next
Judge Tigar's ruling implemented a 14-day stay to allow the administration to comply. During the stay, nothing changes, but Judge Tigar has stated that he will not allow the ban to be stayed indefinitely. The administration has already appealed, and they will likely ask a higher court for a stay. The road ahead is long, but Judge Tigar's ruling is a victory that reminds us that asylum is a right, not a privilege. In the mean time, people of faith should continue to lift up the importance of robust asylum protections to their communities and elected representatives.
