Hamilton, Ohio Officer Stephen Heffernan was found NOT GUILTY on all four misdemeanor assault charges. A judge ruled that his actions were “objectively reasonable” after a 62-year-old man in custody became combative and non-compliant while handcuffed in the booking room. The man had to be taken down and ended up with a head injury. Bodycam and security footage was reviewed. The judge watched it and still said the officer’s response was reasonable under the circumstances. When citizens push back or assert their rights, the response is often force first and justification later.
