πŸ€“πŸš¨ There are some really interesting (for lawyers and absolute geeks) decisions in the Burnley v Everton case. There have been multiple procedural and technical arguments over the last 3 years which we now see. Most of the decisions actually limit potential claims and make claims harder which is contrary to the perception in the reporting so far (largely because I suspect almost nobody has had the time or inclination to read it the decision). But this one below (which I think has to be a correct analysis), also envisages situations where a claimant club could go after another club in TWO separate cases - one under Rule W51.5 compensation for established breaches (so far that is Everton, Forest, Leicester and Chelsea (City pending)) AND then also have a separate crack under Rule X. This could mean that if a club felt that the Independent Commission got something wrong or underplayed a breach it could take Rule W compensation and still bring an additional claim under Rule X. Absolute chaos.
