WE WON AN ABORTION CASE IN STRASBOURG!
Our lawyers, B.A.
@kamila_ferenc and B.A.
@AgataBzdyn, for the last two years have been representing M.L. before the European Court for Human Rights in a case against Poland.
During M.L.'s pregnancy, the fetus was diagnosed with developmental abnormalities. An abortion was scheduled to be performed at a hospital on 28 January 2021. However, in the middle of the night, M.L. received a message from the hospital that the pregnancy would not be terminated due to the infamous rulling of the Polish Constitutional Court (banning legal abortion on the grounds of foetal abnormalities) had entered into force the day before (27 January). In her rapidly deteriorating mental state, M.L. had to organise a trip abroad within a few days, leaving her family and loved ones in Poland. For an abortion, which only a few days earlier would have been performed for free in a nearby hospital, she had to travel to the Netherlands. She spent more than 5,500 PLN (1220 euro).
The European Court of Human Rights in Strasbourg made a clear decision decision: the pseudo-ruling of the Polish Constitutional Court, issued by an illegitimate body, constituted an unlawful interference in M.L.'s private life and violated Article 8 of the European Convention for Human Rights.
We fought for this decision for every woman living in Poland. This verdict is a milestone and another argument that Polish law, which causes so much suffering for women in Poland, must change. We expect the new Polish government to liberalize abortion law. A return to the legal situation before the ruling of the Polish Constitutional Court (i.e. three, strict legal basis for the abortion) is not enough - what is needed is access to legal abortion regardless of the reason.
