BOMBSHELL MOTION FILED – AUSTIN DA JOSE GARZA CAUGHT IN 3-YEAR COVER-UP
Travis County DA’s office secretly planned to INDICT THE CITY OF AUSTIN for APD’s actions during the 2020 riots…then hid the entire scheme when they botched the statute of limitations.
Instead of disclosing this explosive exculpatory evidence to indicted Officer Chance Bretches (and the public), they buried it – while prosecuting junior line officers who followed orders and used the defective bean bag rounds issued by the city. Evidence of an un-indicted co-defendant or an alternative suspect is always required to be disclosed to the Defense and ensures a fair trial.
Sworn affidavits from former Assistant City Manager Bruce Mills and ex-Council Member Mackenzie Kelly prove it: multiple secret meetings with Garza himself, negotiations to make the City “take accountability” in exchange for dropping cop charges, then total radio silence to the defense.
This isn’t a mistake. It’s deliberate. It violates Brady, the Michael Morton Act, the Texas Code of Criminal Procedure, the Disciplinary Rules, and the Court’s own orders.
Our motion demands DISMISSAL WITH PREJUDICE – and lays out the DA’s patter of misconduct towards law enforcement (sanctions in other cop cases witness tampering allegations included).
No other remedy protects the defendant’s rights. And no Judge can ever be sure that all of the evidence will ever be disclosed as required by law.
