I’ve been at this a long time and I can’t recall seen a bill referred to another committee to avoid a discharge petition. Much less a bill referred from Education to Health to Judiciary to Children & Youth and back to Health. That’s how bad house Democrats want to avoid a vote.

Charlotte-Mecklenburg Schools just paid $95K for a lesson on the First Amendment. That payment is part of a settlement with Gabby Stout— the high school student who painted a patriotic tribute to Charlie Kirk on a spirit rock last year. Although Gabby had gotten permission—and although other students had been allowed to paint messages in support of causes like Black Lives Matter—school officials responded to Gabby’s message by painting over it, publicly accusing her of vandalism, interrogating her at school, and calling the police. @ADFLegal helped Gabby sue the district late last year. Now, besides the payment, the district has issued a statement of regret for its actions and changed its policies to respect students’ free speech rights. Schools can’t censor student speech just because they don’t like its message. ADF is thrilled to get this vindication for Gabby, who courageously lived out her own admonition to “live like Kirk.” I think Charlie would be proud.

House Health Committee sunshined votes on three bills to restrict how trans athletes compete in school and intercollegiate sports. So far, every vote on these bill has been a referral to another committee to short-circuit discharge petitions.

Could putting the SAVE America Act in a reconciliation bill (which can pass with simple-majority support) work? Not under existing rules and precedents—that is, not unless Senate Republicans are willing to be more aggressive in pushing back on adverse rulings from the parliamentarian. In theory it could work, but only if the Senate GOP were willing to get creative and overturn adverse rulings from the parliamentarian. I don’t see a path for that strategy to work, at least not at the moment. Absent some change indicating a willingness to overturn the parliamentarian, the best—and likely the only—chance for this bill is to put it on the floor and debate it until it passes.
