Per #abalel panel: You can’t blindly rely on third-party administrators (“TPAs”) for employee disability/accommodation issues. Company is still ultimately responsible for legal violations by the TPAs.
Per #abalel panel: Even if employee tells manager “I’m about to tell you something, but I don’t want you to tell anyone,” the company is likely still on notice of the issue. Very important to train those managers about what to do in that situation.
