Indeed! The issue is organization. There is a flaw in the Constitution. Intentionally? The main flaw being we turned our courts over to the States and the federal government.
However, in a 1992 case, United States v. Williams, Scalia stated that the Grand Jury belongs to the People and is independent of any and all branches of government. We the People are unorganized hence we have not come up with a mechanism to call a grand jury or to finance its staffing, investigations, and operations. However we have every right to do so.
I believe we also have a right to hold our own common law court. But once again we are not organized to do so.
So really what has to happen is we have to organize, then finance, staff and control the operations.
