🚨JUST IN: The @SECGov and @CFTC have issued joint, Commission-level interpretive guidance outlining how federal securities laws apply to certain crypto assets and transactions. This follows a submission to OIRA earlier this month signaling the agencies’ intent, and was approved by all three SEC commissioners (Atkins, Peirce, Uyeda) as well as @ChairmanSelig. The guidance establishes a token taxonomy and addresses how activities like staking, mining, airdrops, and wrapping are treated under existing law. Notably, SEC Chair @SECPaulSAtkins says it reflects that most crypto assets are not themselves securities and that investment contracts can come to an end. While interpretive guidance doesn’t change the law, it reflects how regulators intend to apply it, giving the market a clearer directional signal. Separately, this is distinct from the SEC’s still-pending rulemaking on crypto asset offerings.

If you think it’s just about the foundation bidding memecoins you’ve missed the plot / the root complaint is about communication, transparency, direction, and having motion. Like I said on Jan 1, the tech is built and it works, so this year it’s about making money, but nobody knows where we’re going. We, the community, stood on business and fought FUD against other tribal communities who are now ghost chains during the entire bear market. We made money together during the rush seasons, formed cliques, built cool things, and constantly posted about “horizontal scaling”, sub second TTF, network upgrades to increase TPS, reduce gas fees, institutional adoption, chain metrics, why Avalanche is built better and different etc. We believed in all the things we were told and over the last 9 months nobody knows what the hell is going on anymore. On chain sleuths see large transfers to Coinbase and what was a meme is just met with obfuscation and 👀 . Key leaders and employees on the chain have been fired or voluntarily left as well. Meaningless metrics of showing record wallet counts and transaction counts and volume with no real users behind it, while our leading apps and tokens sit at ATL market caps. I’m down for whatever because I’m building things and helping other teams and will bring the community on the way to wagmi, but maybe if the decision makers would just say it like it is and tell us what is going on it would stop 90% of the drama. Also, crypto is inherently different because you can just tag or DM the CEO of a billion dollar company and have a conversation with him. Much different than a share holder of stock. Your crypto company’s market cap is tied directly to the demand for your token so it is different, so maybe treat it differently. Give the lads something to be bullish on. I wish I didn’t write this tweet now.
