Wife's in-hand salary is ₹1,41,436 per month. Husband also has to support his parents financially. Wife argued that she has the right to maintain a lifestyle similar to the one she enjoyed during the marriage. The court ordered the husband to pay her ₹1,35,000 per month as maintenance. Now, wife's total monthly income will increase to ₹2,76,436. After paying maintenance, the husband's remaining monthly income will be ₹1,44,499. He cannot claim any tax deduction for the maintenance he pays. Under income tax rules, maintenance is considered a personal expense, not a deductible expense. This means he must still pay income tax on his full salary, including the ₹1,35,000 that goes to his wife. Wife may also have to pay income tax on the maintenance amount if it is treated as taxable income under the applicable tax laws. ITD won.
