Khumalo SC from Madlanga Commission had long planned to be at the World Cup. He’s not gone because of the commission’s work. 🇿🇦

Let me address this: Maj-General Feroz Khan's attorney Muhammed Vally filed the complaint last week after I attended urgent court and wrote a story based on the papers. Firstly, it is not true that on the caselines system I appear as a judge. I sent proof to the OCJ.
🚨Shocking details emerging from the Feroz Khan matter reveal concerns raised by his legal team about access to the judiciary's digital CaseLines system. In a letter to the Office of the Chief Justice, Khan's attorneys say they became concerned after media reports contained details from his founding affidavit before the matter had been argued. 🧵1/..

I haven’t read Khan’s court papers but am curious as to whether they deal with the 2015 SCA judgment in the SANRAL case: “all court records are, by default, public documents that are open to public scrutiny at all times”.
In fairness to him, he should complain if he believes the information in his affidavit was in the press before the matter was argued in court. Complaining about leaks is also not unusual. Public figures facing criminal or disciplinary scrutiny frequently raise concerns about "trial by media" and selective leaking. We have to wait and see if there's merit in his complaints- and only an investigation into the Caselines issue can tell.

The judgment expressly set aside a WCHC judgment that found that it was only once a matter argued in open court that the documents became public. Fantastic judgment on open justice by Ponnan JA.

The history of how this came about is interesting and inspiring: from what I have read, it was a synergy of two streams of mobilisation and struggle - one inside SA and another inside the ANC in exile. Inside SA, there was the formation of GLOW in 1988 by Simon Nkoli, @bevditsie
south africa is the first country in the world to constitutionally and explicitly ban discrimination against sexual orientation. and it is not the work of any white individual.

Erm, a correction to one of my tweets: “an unequivocal decision against discrimination on grounds of sexual orientation”. Apologies.
