While it is true that autopsy is desirable in murder case. The position of the law is settled that the production of a medical report where the cause of death could be inferred from the circumstances, is not a necessity and failure of the prosecution to tender same is not fatal. So although, autopsy is desirable, where the cause of death is obvious, medical evidence ceases to be of any practical or legal necessity in a homicide case. See the case of Okorie v. State (2018) 11 NWLR (Pt. 1629) 1. Page 24, Para D-H where Supreme Court held as follows: “Now as regards issue 3, I do not understand this brouhaha about medicalreport, whereas there is direct evidence of an eyewitness who saw the appellant taking part in the beating of the deceased who died on the spot and at the scene…Having said that, the law is well settled that although medical evidence isdesirable, a medical report is not a sine qua non in determining the cause of deathin a murder trial where there are other evidence upon which the cause of deathcan be inferred to the satisfaction of the court. Thus, the energy and resources spent by the parties to this appeal on the issue of autopsy report flies in the faceof the raw facts before the trial court as to the participation of the appellant inthe killing of the deceased. I agree with the Court of Appeal, which upheld the decision of the trial court that medical evidence was not really of any moment inthe determination of the cause of death of the deceased.“ I hope this helps. In 2007, she adopted her 469th child, and by the year 2008; she had already cared for over 500 children. This act earned her the nickname “Olomo yeye”, which means someone with many children.
