Paragraph 4, Tenth Schedule (Anti-Defection Law) of the Constitution of India. An MP or MLA will LOSE THEIR SEAT or be DISQUALIFIED under anti-defection law UNLESS their original political party MERGES with another party; and They either: *Join the new/merged party, or *Refuse to join the original merger. Crucial condition is that the original party HAS TO MERGE with another party or THEY HAVE TO MERGE with another party. NO LEGAL PROVISION of a ‘separate group’ inside Parliament or inside the assembly while sitting on a MP/ MLA seat previously won on the ORIGINAL PARTY’s name and symbol. The LAW IS CLEAR. NO “ SEPARATE GROUP” inside the House on the same symbol is legal. MERGE with a new party or be DISQUALIFIED. Else your membership of the House - parliament or assembly - is ILLEGAL.

Sending MPs to claim TMC is "indivisible" is just legal bluff to hide the implosion. 📜 Under Anti-Defection Law, if 2/3rd of elected members split, they are completely protected from disqualification. 20 out of 29 Lok Sabha MPs mathematically crosses that exact threshold. 📉 No strongly worded letter or past judgment can stop a Constitutional process when numbers are entirely against you. Ground has already shifted. 🏛️

Congress leader and Senior Supreme Court Advocate @DrAMSinghvi very strong words on TMC political turmoil "I am not one of those who think that there is no dissatisfaction, anger in those who have left the TMC. I am also not one of those who think that the BJP alone is the reason for them to leave. But let me make a few points crystal clear... ▪️Never before in the 75-80 years of Indian history has any party misused agencies, that includes past BJP Govts and non-Congress Govts, to even 1/10th the extent which this Govt has done. ▪️Secondly, in the last 75-80 years of Indian political history, no party has aggregated and misused as many monetary resources as this ruling party. ▪️Third, there is no doubt in my mind that there are categories of people. You cannot equate a Suvendu Adhikari with the others who have left. Suvendu Adhikari may have had serious differences but he had the guts to leave the party years ago. He fought on the ground, he carried a campaign, he won the elections, he became the CM. That is the democractic way of doing. You may not agree with him but you cannot criticise him for this. There is a second category of a very small number where people have left after 5th May 2026. But they have at least had the moral courage to resign their seats. The third category is the largest, they are not prepared to leave the office, they are not prepared to leave their greediness, they are not prepared to leave anything of the TMC which got them where they are. So, what kind of category is this? This is nothing but immoral. ▪️Fourthly, there is a huge complete, ridiculous conceptual distortion that anywhere any legislature party - if so called 2/3rd walk out and form a group then the anti-defection law doesn't apply. This is the most ridiculously wrong interpretation and is based on complete ignorance or deliberate non-understanding of the existing law which has been decided by the Supreme Court. ▪️Fifthly, pick up and read the Shiv Sena judgment of 2022. There is no concept of a 2/3rds simplicitor in the legislator party which will prevent the application of the 'dal badal' anti-defection law. They will be subject to disqualification. However, in this country, the process is the punishment. Everybody knows the law but I, as an existing TMC and Mamata Banerjee, will file a complaint against you that you have left. That complaint will go to the Speakers of the Assembly and Lok Sabha. Is it possible to contemplate that those Speakers who belong to the ruling party will allow my complaint? They will reject and those people will be recognised. I will go to court and the court will take 3-4 years. ▪️Lastly, I have been advocating for many years that you must repeal all this farce of the 10th Schedule. You must have a 2-line 10th Schedule which says that anybody who is elected on symbol x and party y and who does directly or indirectly any other anti-party activity and joins/support any other party must resign the post he holds and refight the elections..."

TMC lecturing Speaker on Constitutional law is hilarious. That warning letter is a meaningless stunt. Rules are simple: secure a 2/3rd majority, and you can legally split. 20 out of 29 MPs gives them exactly the number needed to bypass anti-defection law. You cannot mandate loyalty on paper when 70% of your MPs have already walked out the door. They are just begging for time. ⏳

@AITCofficial Warns Against Rebel Faction, Urges Speaker Not to Grant Recognition New Delhi: In a strongly worded letter to the Speaker of the Lok Sabha, AITC National General Secretary and MP Abhishek Banerjee has urged that no recognition, facilities, or independent status be granted to any purported breakaway group of AITC MPs amid media reports of a possible rebellion within the party. Banerjee argued that the anti-defection provisions under the Tenth Schedule of the Constitution do not permit political party splits, noting that the legal protection once available to defectors on the ground of a “split” has been abolished. He maintained that any attempt by MPs to form a separate faction would attract disqualification proceedings. Citing a 2023 Supreme Court judgment, the AITC leader stressed that the political party holds supremacy over its legislative wing. According to the letter, MPs do not possess the authority to independently appoint leaders or whips and remain bound by the decisions of the party’s central leadership. The letter further clarified that the only exception available under the anti-defection law is in the case of a valid merger. Banerjee stated that such protection requires both a merger of the original political party with another party and the support of at least two-thirds of the legislators. Since no merger involving the All India Trinamool Congress is under consideration, any move by a group of MPs to function separately would be unlawful, he argued. Warning of strict action, Banerjee said any MP who projects themselves as part of a separate faction, abandons the party, or violates the official party whip could face immediate disqualification from the Lok Sabha. He also requested the Speaker to place the submission on record, deny parliamentary recognition or facilities to any rebel faction, and ensure that the officially designated AITC leadership is given a formal hearing before any request from a breakaway group is considered.

Letter asserts: -AITC is single indivisible political party -LS Legislative party derives its existence from political party -No set of members can carve out separate faction by their own volition Desperate letter to Lok Sabha Speaker is pure political theatre. 🎭 Tenth Schedule is crystal clear: if 2/3rd of a party splits, anti-defection law does not apply. TMC has 28 MPs. 2/3rd is 19. Exactly the number of rebels walking out. 🧮 You can cite Supreme Court judgments all day, but legal bluff cannot override basic math. Syndicate isn’t citing law. Just panicking. ⏳
