Durante siglos, la ley fue texto. Luego interpretación. Luego aplicación.
Ahora empieza a convertirse en infraestructura. No hablamos de jueces robot ni de constituciones automáticas. La transformación comienza mucho antes: en permisos, licencias, impuestos, compliance, contratación, reportes regulatorios y supervisión continua.
El derecho deja de ser algo que se consulta después de actuar y empieza a convertirse en algo que acompaña, verifica y ejecuta durante la acción.
Del cumplimiento retrospectivo al cumplimiento en tiempo real, de la norma escrita al sistema que corre.
Por eso la automatización profunda no empezará en la @CConstitucional ni en las decisiones políticas fundamentales. Empezará en la capa administrativa intermedia del Estado, donde predominan reglas, umbrales, formularios, evidencias y procedimientos.
¿Qué parte del derecho debe entrar al runtime y qué parte debe permanecer bajo juicio humano?
Ejemplos: Un pago se verifica contra reglas de compliance antes de ejecutarse; una licencia se concede automáticamente al comprobar requisitos; un contrato monitorea sus propias obligaciones; un subsidio se activa o suspende según datos actualizados; una transacción tributaria calcula y reporta impuestos instantáneamente. El derecho deja de ser solo texto e interpretación posterior para convertirse en una capa operativa que supervisa, alerta y ejecuta cumplimiento en tiempo real. En palabras de #Wright: las instituciones comienzan a comportarse como software.
