Absence of guidelines on “acceptable inequality” in exposure to toxic air is no longer just an oversight — it is active concealment leading to grave injustice.

Supreme Court has repeatedly held (M.C. Mehta 1986, Subhash Kumar 1991, Vellore Citizens 1996, MK Ranjitsinh 2024) that
• Right to pollution-free environment is fundamental under Art 21
• Precautionary principle & equality (Art 14) are binding
• Disproportionate burden on any community is unconstitutional.
Yet CPCB has never defined what level of differential exposure is permissible.

MoHFW/NCDC itself admits (Health Advisory Oct 2023):
“Long-term exposure to even lower levels of air pollution can cause lung cancer, respiratory & cardiovascular diseases and premature deaths.”
→ There is NO SAFE THRESHOLD.

Despite this knowledge, CPCB refuses to publish:
• Maximum permissible gap in cumulative exposure (Area Under Curve of concentration × time) for PM2.5, NO₂, O₃, benzene, BaP etc.
• Acceptable disparity ratios between “clean” and “poisoned” zones
→ This deliberate silence creates legal ambiguity and forces citizens into endless litigation.

Result?
• Poor & marginalised communities breathe 10–15× higher pollution year after year
• Polluters exploit the vacuum — no benchmark = no violation
• Courts are flooded with PILs because statutory bodies abdicate their duty to quantify & enforce equality in the most basic right: breathing.

Air (Prevention & Control of Pollution) Act 1981 was enacted to prevent exactly this kind of disproportionate poisoning of vulnerable populations.
By not issuing differential-exposure thresholds, CPCB is defeating the very object of the Act and encouraging systemic environmental injustice.

We demand immediate release of scientific guidelines on maximum permissible inequality in cumulative exposure to criteria pollutants & toxics.
Hiding behind “no data” is no longer acceptable when lives are being lost.
