What is wrong with the new UGC regulations? (🧵)
1. Based on faulty assumption (aka fake narrative) of "rampant caste-discrimination on campuses"- There is no data to back such claims.
2. Definition of "Discrimination" expanded & made ambiguous. Any "implicit" act, any action without "intent", still can be considered as discrimination if someone feels it is.
3. Definition of caste-discrimination explicitly mentioned.
Only SC, ST, OBC included as possible victims. Excludes general category as possible victims of caste-discrimination.
Means GC are automatically presumed to be "oppressors".
4. No burden of proof on complainant. Works on principle of "Guilty until proven innocent".
5. No action on fake complaints. Means ppl are given free hand to file false complaints, without any fear of repurcussions.
6. Inclusion of civil society members, NGOs, Police officials in campuses. Can lead to polticization of entire academic environment.
7. Scope of discrimination expanded to include faculty & staff members, in addition to students.
Means now faculty or staff members are also possible targets. Worse, now there is a possibility that a SC/ST/OBC faculty member can also be "discriminated" by a GC student.
8. Narrow window for action on complaints.
Means very strict timelines: committee meeting in 24 hours, report in 15 days, action in 7 days.
9. Continuous oversight through equity squads & unit-level equity ambassadors. Promotes a fearful environment, snitching, lack of trust, possibility of high misuse of such ambassador power in campuses.
10. Penalty for colleges on non compliance. Which will force colleges to follow unnecessary bureaucracy & open gates to foreign funded, agenda-driven NGOs & civil societies.
11. The UGC guidelines overstep their boundary of UGC Act, 1956, by bringing such guidelines.
Overall effects:
-Constant fear among students & faculty
-Faculty may ease evaluations criteria for the fear of being targeted
-Promotes distrust amongst students
-Weaponisation of these provisions to settle personal scores or political conflicts
-Puts a target on the back of General category (students & teachers)
-Effectively turns campuses into Gestapos
