Facing Psychological Abuse at Work? Your Rights Under Australian WHS Laws
Psychological abuse -bullying, harassment, yelling, exclusion or toxic behaviour - is a serious psychosocial hazard under Australia’s Work Health and Safety (WHS) laws.
Employers (PCBUs) have a primary duty under the WHS Act to ensure, so far as reasonably practicable, that workers are not exposed to risks to psychological health. This includes identifying, assessing and controlling hazards like bullying, aggression, poor relationships and high job demands.
Your Rights:
•A psychologically safe workplace
•Raise safety concerns without fear of victimisation (unlawful under WHS)
•Be consulted on hazards
•Refuse unsafe work if you have a reasonable belief of immediate or imminent serious risk to your health (s84)
•Protection from retaliation
What to do:
1Document every incident (dates, details, witnesses, impact)
2Report internally (manager/HR/HSR) and request action
3See a GP and access counselling/EAP
4Escalate if needed: Contact your state regulator (SafeWork, WorkSafe etc.), apply to Fair Work Commission for a stop-bullying order, or pursue workers’ compensation
Early action protects your health and strengthens any claim. Laws apply nationally with minor jurisdictional differences.

■ 호주 71세 노조교사, 소유마에게 차여 별세… 경주마는 주인 잃은 줄도 모르고 달렸다
지난 15일, 호주 뉴사우스웨일스(New South Wales)주 스콘(Scone) 경마장에서 71세의 노조교사가 자신이 자식처럼 아끼던 말에게 차여 사망하는 비극적인 사고가 발생했다. 더욱 가슴 아픈 사실은, 해당 경주마가 조교사의 생에 마지막이 된 경주에 사고 직후 그대로 출전했다는 점이다.
이번 사고의 희생자는 탬워스(Tamworth)를 기반으로 활동해온 베테랑 조교사 겸 마주 스티븐 메이어(Stephen Meyer)다. 그는 이날 스콘 경마장에서 마지막 경주를 준비하던 중, 마방에서 '댄자인더다크'(Danza in the Dark, 9세, 거)에게 가슴 부위를 차였다. 현장에 있던 의료진이 즉각 응급조치를 시행하고 헬기를 통해 후송했으나, 메이어 조교사는 끝내 숨을 거두었다.
이번 사고는 단순한 현장 안전사고를 넘어 호주경마계에 깊은 슬픔을 안겼다. 스티븐 메이어 조교사는 대규모 자본이 투입된 마방이 아니라, 오직 단 한 마리의 말과 자신의 이름을 나란히 올린 전형적인 1두 마방 조교사였기 때문이다.
실제로 '댄자인더다크'는 메이어 조교사가 생전 인터뷰에서 "우리의 유일한 말"이라고 부를 만큼 각별한 존재였다. 이 말은 메이어 조교사에게 통산 6승 전부를 안겨준 주인공이기도 하다. 비록 화려한 대상경주는 아니었지만, 지역 경마인 월차 컵(Walcha Cup)과 퀴린디 컵(Quirindi Cup)을 제패하며 소규모 마방의 저력을 보여주었던 메이어 조교사에게 '댄자인더다크'는 관리마 이상의 가족이자 파트너였다. 해당 경주마의 소유권 또한 메이어 조교사와 그의 배우자 명의로 등록되어 있어, 이들의 관계는 사실상 가족 공동체에 가까웠다.
그러나 메이어 조교사를 쓰러뜨린 '댄자인더다크'는 사고 직후 진행된 스콘 경마장 제8경주 바이너리 컨트리 컵(Vinery Country Cup, 1400m)에 그대로 나섰다. 현지 수의사의 마체검사 결과 출전 양호 판정이 내려졌고, 안장에는 로리 허칭스(Rory Hutchings) 기수가 올랐다.
주인을 사지로 몰아넣은 '댄자인더다크'는 16두 중 16위로 결승선을 통과했다. 우승마와는 23.4마신이라는 큰 격차였다. 자신을 평생 돌봐온 마주가 생사의 기로에 선 순간, 영문도 모른 채 주로 위를 달린 말은 결국 가장 뒤처진 채 경주를 마쳤다.
이번 사건은 호주경마 현장의 안전 문제를 다시금 수면 위로 끌어올렸다. 세이프워크 NSW(SafeWork NSW) 등 현지 산업안전 기구들은 말 취급 관련 업무를 사망 사고 위험성이 있는 고위험군으로 분류하고 있다. 특히 인력과 장비가 부족한 소규모 마방일수록 말과의 밀착 접촉 과정에서 발생하는 위험을 오롯이 조교사 개인이 감내해야 하는 구조적 취약점이 이번 사고로 여실히 드러났다.
호주 터프 클럽(ATC)과 레이싱 뉴사우스웨일스(Racing NSW)는 사고 직후 추모 성명을 발표했으며, 경마장 내에 조기를 게양하여 고인을 기렸다. 71세의 나이에도 단 한 마리의 말과 함께 주로를 누비던 노조교사의 꿈은, 그가 가장 사랑했던 말의 발길질에 허망하게 마침표를 찍고 말았다.
