Attempts to block or heavily delay Colin Albert’s deposition carry real strategic risk. Colin Albert will almost certainly be deposed. As a key percipient witness to the events at 34 Fairview, his testimony is highly relevant. While his Army service and non-party status in the wrongful death case entitle him to reasonable accommodations under Rule 45 and the SCRA, military obligations rarely serve as a complete bar to relevant discovery. Courts typically order the deposition on a new date with appropriate conditions once initial conflicts have passed. The bigger danger: If his side aggressively fights the deposition in the wrongful death case, those same military-duty arguments could be turned against the plaintiffs in the parallel defamation case—where Colin is a plaintiff. Courts are far less sympathetic when a servicemember-plaintiff seeks to delay a case they chose to bring. Judge Gildea is unlikely to reward inconsistent positions across the two related matters. What feels like a short-term win could end up slowing or stalling the very lawsuit the plaintiffs want to advance.
Colin is not “evading” anything. A non-party does not become an open file cabinet just because Karen’s team wants more conspiracy nonsense. Karen's lawyers served a subpoena with a specific date, time, and place, then tried to treat it like a floating subpoena after that date passed. Rule 45 says the subpoena commands testimony “at a time and place therein specified.” Colin’s subpoena specified April 29, 2026 at 10:00 a.m. That was the command. It was not an all-access June calendar hold. Colin is a non-party. There is NO evidence that he was present at 34 Fairview when John O’Keefe died. He is not the defendant in the wrongful death case. His lawyer had every reason to push back on relevance, burden, scope, and scheduling. That's not evasion; it's civil procedure 101. Karen’s lawyers got called on it, and then tried to turn their own dusty subpoena problem into another way to smear Colin's name. Look at him, not me! Rule 45 protects non-parties from undue burden and expense. That is the whole point. Rule 45(b): “A party or attorney responsible for issuing and serving a subpoena must take reasonable steps to avoid imposing undue burden or expense on a person subject to the subpoena.” And the protection language when production is compelled: “Such an order to compel production or inspection shall protect a person who is neither a party nor a party’s officer from undue burden or expense resulting from compliance.”
