I have an important update regarding the ongoing case involving Cynthia Brown, Carlos Buford, and Jenny Sue Rowe against David Yost, the Ohio Attorney General.
Recent Developments:
The Sixth Circuit has denied the petition for initial en banc review. The order indicates that while some judges voted in favor, there was not a majority. which means we will now proceed to a three-judge panel, similar to our previous successful round.
What This Means:
1. **Three-Judge Panel**: The case will now be reviewed by a three-judge panel. Given our past success with this format, we are optimistic about the potential outcomes.
2. **Impact of the Split Vote**: Since the en banc court could not achieve a majority to hear the case, if we win again at the panel level, the en banc court will not be able to rehear the case, which is advantageous for us.
3. **Next Steps**: We are currently awaiting the panel’s decision on whether to lift the stay. This ruling will be crucial in determining how we proceed.
