I can’t explain to you the absurdity republicans have had to go through. Biden had over 160 conservative creators and elected officials under FBI investigation. That includes illegal wiretapping. Mind you, I was a Democrat at the time. Covid and the Lawfare really woke me up to who the bad guys are.

Maybe you don't remember a time where we were not recorded or photographed more than a couple times a year, but I do. And yes, catching private conversations for example, can break wiretapping & eavesdropping laws. But surveillance culture sucks no matter the laws.

I think the general consensus is, is that if you are in a "private place", where the person being recorded has a general expectation of privacy, then "wiretapping" comes into effect if they are being audio recorded.

But the OP is pointing out that in some jurisdictions, video recording is legal whilst audio recording (including video with audio) is illegal, and usually on the grounds of being considered "wiretapping"

congress.gov/bill/108th-cong… Openly recording in a bathroom also violates federal wiretapping laws. A bathroom is a location where a person has a reasonable expectation of privacy. There are many state laws prohibiting this as well.

Generally speaking the law allows you to record "in public" even in secret and even if you are being extremely creepy about it. Pretty sure the 1-party and 2-party consent laws are basically about wiretapping.
