Last week I was privileged to discuss #decentralisation in #Mozambique with 2 groups of super-motivated central government officials, convened by @giz_gmbh and the Ministry of State Administration & Public Service in idyllic Ponta do Ouro.

The road ahead is challenging, but decentralisation is firmly entrenched in the 2018 Constitution and offers prospects to deepen democracy, further development and sustain stability in Mozambique. We discussed lessons from South Africa, Kenya, Zimbabwe & Uganda.

(1) Great analysis. The victory may be meaningless in the context of the Jhb numbers game. The procedural points are simple. But the Court's scathing finding on the Speaker's 'ulterior motive' are not. It starts a jurisprudence on coalitions:
A quick thread on pragmatics of politics in our metros. With DA’s @mphophalatse1 reinstated by a legal victory on procedural grounds, victory will be meaningless if her detractors follow due process & oust her procedurally? Key decider = who has how many seats?

In essence, the Court said: 'Do what you must, it's politics. But respect the law as you do it.' Even when the Court was urged to overlook procedural mishaps and allow democracy to run its (perhaps inevitable) course, the Court refused. That's important, I think.

Legislation will not solve coalition problems. But to be fair, most of it was drafted in a time when we really didn't think much of that possibility. There are some small gains possible with law reform.
Coalitions are here to stay. Like them or love them. Voters aren’t keen to hand out majorities any longer. Getting them to work efficiently is key to delivering on citizen needs & public services. But… is legislation the way to solve their inefficiencies?

Also, forcing the election of office-bearers to happen within 14 days of a general election is setting the municipality up for failure. Coalitions are rushed, haphazard and more likely to fail. Coalition building needs more time and the law can make that possible.

Lastly, can we can rein in the disproportionate power of kingmakers without eroding democracy? It's ok to over-compensate small parties for the risk they take in joining a coalition. But giving the mayoral chain/speaker's hammer to a party that 1% of the electorate believes in...
