The @Cofek_Kenya has moved to the High Court in Milimani challenging several provisions of the Finance Bill, 2026 and seeking conservatory orders to stop their enactment and implementation pending determination of the petition. The argument is that Parliament is in the advanced stages of passing tax measures that will restructure how Kenyans are taxed on everyday transactions without adequate safeguards for consumer protection, privacy, public participation and fair administrative action as required by the Constitution. COFEK warns that once the impugned provisions are passed and brought into force, the resulting constitutional injury to taxpayers and consumers may be immediate and difficult to reverse. COFEK specifically challenges new tax burdens on digital payments, scrap metal transactions and virtual assets as well as the proposed removal of a number of VAT exemptions and zero-rated supplies. For digital payments, the federation argues that expanding the tax and fee net around payment processing systems, card schemes and other financial infrastructure will raise operating costs for banks, fintechs and payment service providers which are costs that will inevitably be passed on to ordinary Kenyans through higher transaction charges and merchant fees. On scrap metal, the petition highlights the proposed 1.5% withholding tax on gross proceeds, warning that taxing turnover rather than actual income will disproportionately hurt low‑income youth, waste pickers and small dealers whose margins are already extremely thin. Equally significant is COFEK’s concern over the removal of VAT exemptions and zero‑rating on essential goods and services such as basic foodstuffs, health products, agricultural inputs and educational materials. The petition argues that converting these supplies to the standard 16% VAT rate will inevitably push up production and distribution costs, with higher prices being borne by households already struggling with the cost of living. COFEK faults the Finance Bill for failing to provide any clear transition framework or targeted consumer protection measures to cushion Kenyans from the shock of these changes. The lobby therefore urges the Court to preserve the status quo through conservatory orders while it interrogates whether the impugned provisions meet constitutional standards of equitable taxation, transparency, meaningful public participation and respect for privacy and data protection in the emerging digital economy.

Update: Mac & Too Agency have asked me to pull down this post as they have said they will pay by Friday. My response is simple. Until the payment is done the post remains up.
When I sold and had this truck delivered in December, I was happy. Partly coz I had ended the year on a high and partly coz of the commission that I anticipated. As a freelance sales person, I don't have a retainer or stipend. So when you deliver a truck sold on full price, that's when you have the opportunity. I was attached to an agency called Mac & Too Agency who are one of the suppliers to @CFAOMobilityKE. The issue I have is with Mac & Too and not CFAO so please don't misquote that. The person that has been handling this @ Mac & Too is called Mary Anne Chebet. She initially told me in January that Mac & Too had issues with KRA that needed resolving. Fast forward to April, that is when they resolved the issues. The claim for commission was initiated and monies paid to Mac & Too accounts on May 6th and payment was to reflect on 20th May given the 10 Working days that Payables @CFAOMobilityKE had mentioned. (Evidence on the screenshot). Since then, getting an update from Mac & Too has been a task. From blueticks to unanswered calls. As a freelance sales agent, my only main stay is commission and when delays like this especially when someone decides not to update or be proactive to ensure it is resolved and bills pilling, I have no other alternative but to bring this here. All I want is my money. Not interested in explanations whatsoever.
