En ikke helt uinteressant sag om terrorstøtte (lyder som en udvidet medvirkenssigtelse) og billigelse. Hvis salg af tøj med budskaber om 7/10-angrebet anses for terrorbilligelse, så er der vel ikke langt til, at det samme vil være tilfældet, hvis man bærer tøjet eller lignende.

Spændende. Så en krig indledes ulovligt (jus ad bellum), udkæmpes ulovligt (jus in bello), fører til ulovlig regulering af et stræde (havret), som fører til en ulovlig blokade (jus ad bellum igen). Mit fag tager godt nok nogle tæsk for tiden.

This is an excellent piece on the situation in the Strait of Hormuz. I agree that the Iranian transit fee regime is unlawful - but I’m not sure that the transit passage regime can so easily be assumed to simply apply on a customary basis to non-parties to UNCLOS.
The current situation in the Strait of Hormuz is untenable. The Strait is not "open." The Iranian toll-collection regime, left in place by Trump-Hegseth deal, is "in flagrant violation of the law of the sea.” Read this learned piece by former Navy Commander @marknevitt 1/

It is interesting to note, for example, that the Danish jurist, Erik Brüel, argued (in 1940) that when Denmark agreed to stop collecting Sound Dues in 1857, Denmark was essentially giving up a right that no longer existed under international law at the time.

The problem for the US is that it cannot with a straight face rely on such legal norms after having so openly declared its complete disinterest in international law - and after having so clearly violated it in Iran.
