Jeffery Lee has just hours left until Alabama intends to kill him. Though two separate courts have ruled nitrogen suffocation as unconstitutional - the furthest any challenge to an execution has ever gone - we are still in limbo awaiting a decision by this country's highest court.
All this talk about nitrogen suffocation is overshadowing the legitimate issue in this case - Jeffery would NOT be eligible for the death penalty ANYWHERE in the country today. Even Alabama banned judicial override 9 years ago but failed to make it retroactive.
