India spent a decade learning why retrospective tax is poison. We're about to throw the lesson away. Picture this: your team wins a cricket match, clean, by the rules of the game that day. A year later, the umpire changes a rule and applies it backward — and declares you lost the match you already won. That's retrospective tax. You broke nothing. They moved the line, then pointed it at your past. We did exactly this to Vodafone in 2012, chasing them over a 2007 deal. Cairn Energy got hit too. Both went to international arbitration. Both won. India refunded over $1.2 billion and spent years as the cautionary tale that every global investor cited as the reason they hesitated on us. In 2021, we finally repealed it and called retro taxation a thing of the past. Capital started trusting us again. This week, the courts upheld retrospective GST on online gaming. Dream11 and an entire industry now owe tax on years of operations under rules that didn't exist at the time. Retrospective tax doesn't punish what you did. It punishes you for not predicting what the government would later wish you'd done. As a country, we should not set such a precedent. #Noretrospectivetax

Govt is such bhikari now that they will use retrospective taxes. This is a double edged sword. This is basically saying after you won something that the rules are changing now and as per that you didn’t win back then as well. Another reason for @nsitharaman to resign and give up because the people have definitely given up on the govt. Don’t know what they smoke up to come with these kind of rules. The govt is already fucking us raw with oil prices and every aspect of living. Now add this too. Imagine if they came and told you that your tax bill is going up because you have to pay for your previous income as well. Utterly disgusting.

By killing transparent, tax-compliant, domestic tech giants that employed thousands of our own people, the state hasn't stopped gambling—they've purposefully funneled millions of Indian users directly into the hands of these illegal, black-market offshore networks Stop hiding behind the fake moral mask of "protecting the public." You don't care about societal harm; you just care about what you can over-tax and control. If you're going to destroy a sunrise tech ecosystem under the guise of public good, ban the actual killers first, or admit this was just a targeted, revenue-grabbing hit job. Imagine running a business for 10 years, collecting and paying 18% GST exactly as required. A decade later, a "clarification" arrives saying the correct rate was actually 28% all along. Now you're told to pay the additional 10% GST for the last 10 years, retrospectively. That's essentially what happened in the RMG case. Whatever your view on the industry itself, retrospective tax demands arising from later "clarifications" should concern every business in India.

I won’t comment on RMG. But, retrospective taxation kills the business environment and entrepreneurial spirit, it should be avoided at all costs. It will hurt the country in long run.

THE supreme court has upheld the 28%GST on Online Gaming fantasy sports ,and real money gaming platform in india The court ruled that when real money is involved in any game, it can be treated similarly to betting or gambling for taxation purposes Simply calling a game skill based” will not exempt it from GST. THIS decision is Major setback for companies like DREAM11 and Gameskraft Earlier, these platforms argued that GST should apply only to the platform fee or commission. However, the court has now clarified that 28% GST will be charged on the entire entry amount or prize pool. The Supreme Court also set aside previous rulings in favor of Gameskraft and accepted appeals filed by the Tamil Nadu and Karnataka governments. Another important point is that state governments may now introduce stricter regulations or even bans on online money gaming platforms in the future. This ruling could significantly impact gaming companies, user participation costs, and the overall online gaming industry in India.
