A little weird tho that a private business CAN choose to DENY a customer because he/she is a member of a protected class, but a private university CANNOT choose to ACCEPT a customer because he/she is a member of a protected class.

Yesterday, Roberts for #SCOTUS said the way to stop discrimination is stop noticing difference. Today, Gorsuch says if you have sincere belief, then you can discriminate and acknowledge difference because it is free speech. Yes, they both signed on to each other's opinion.

Just a general note that most colleges and universities don’t use affirmative action because most schools accept pretty much everyone who applies. Selective universities are a small slice of what “college” is in America.

I've read the opinion 3 times now. This striking down of the most nuanced and limited of approaches to affirmative action is terrible. And it is also important to keep the larger frame of racial inequality in education at the forefront of our minds.

My very quick read of #SCOTUS decision about AA inclines me to believe that institutions could create “colorblind” admission preferences for people with families with historical ties to enslavement, lynching, and colonialism. 1/

Or the institutions could create preferences for Pell recipients, food stamp recipients, or other income/wealth category. These would be a personalized inquiries and not trigger 14th Am strict scrutiny analysis. 2/

My other thought about this opinion is that the schools actually screwed themselves by having such clearly delineated formulas and processes. If their standards were vague and included things like institutional fit, #scotus would not been able to cherry pick and overemphasis 3/3
